On November 5, 2019, Webb Law Group attorneys Lenden F. Webb, Brooke B. Nevels, and Christopher E. Nichols presented at the National Business Institute Seminar on Human Resources Law held in San Diego, California. Webb Law Group attorneys lectured on wage and benefit issues that are commonly experienced by California employees and employers.

            Among the topics covered in Webb Law Group’s presentation were the most common wage and hour traps that California employers fall into. Webb Law Group attorneys were able to share their unique knowledge of handling these types of lawsuits on behalf of both employees and employers. This thorough understanding of both the Plaintiff and Defendant’s perspective allows Webb Law Group to effectively advocate on behalf of their clients, whether they be a large corporation, or an individual employee, as well as to teach these issues to human resources professionals so that they can ensure their company has policies that will avoid wage and hour violations. 

The Presentation

            The presentation covered some of the most common areas where employment law issues are found in California, such as:

  • Unpaid overtime
  • Off-the-clock work
  • Inaccurate paystubs
  • Missed meal breaks
  • Missed rest breaks
  • Employee reimbursement
  • Paid sick leave
  • Late wage payments
  • Reporting time pay
  • Improper deductions from pay
  • Failure to pay final paycheck on time
  • Misclassifying employees as independent contractors
  • Misclassifying non-exempt employees as exempt

These are just some of the most common California Labor Code violations, however, there are many more unique issues faced by both employers and employees. As highlighted throughout the talk given by the Webb Law Group attorneys, employment lawsuits often become class action lawsuits and Private Attorney General Act (PAGA) actions, which are very serious lawsuits that require expert legal counsel to represent both the employee and employer.

A “Hands-On” Approach

Using hands-on practical experience, the Webb Law Group attorneys were able to show the seminar attendees the most common issues that they encounter and to explain the real costs of these common mistakes in terms of the legal damages suffered by employees when the employer does not follow the California Labor Code.
